Betrayal at the Top: FBI Official’s Leak Undermines Investigation

A Justice Department watchdog revealed that Charles McGonigal, a former high-ranking FBI official, compromised a sensitive criminal investigation by leaking details about planned arrests tied to the China Energy Fund Committee (CEFC), a group with business ties to the Biden family.

McGonigal, who led the FBI’s New York counterintelligence division from 2016 to 2018, was sentenced to 50 months in prison in 2023 for colluding with a Russian oligarch to evade U.S. sanctions. His actions, detailed in a DOJ Inspector General report released Thursday, exposed a breach of trust that disrupted a critical probe.

A Web of Warnings: How the Leak Spread

In June 2017, McGonigal met with an Albanian official, referred to as “Person B,” who worked for CEFC. During the meeting, McGonigal hinted at the FBI’s investigation, saying “something to the effect of ‘we are looking into them’ or ‘we are going after them,’” according to Person B’s 2022 FBI proffer interview.

Person B interpreted “we” as the FBI and “them” as CEFC or its affiliates. The next day, Person B traveled to Washington, D.C., and alerted CEFC executive Patrick Ho about potential arrests.

Ho was later warned by CEFC China Chairman Ye Jianming, who passed the information to another FBI target, “Target 3.” At the time, the investigation was highly confidential, known only to a small group of government personnel. In November 2017, Person B contacted McGonigal again, hesitant to attend a CEFC-sponsored event in New York due to the ongoing probe.

McGonigal advised, “Stay in Albania,” adding, “we are ready for them” or “ready for action.” While Person B claimed not to have shared this second tip, Ho attended the event and was arrested on bribery and money laundering charges upon arriving in the U.S.

Biden Family Ties and Private Investigations

Documents from the House Oversight Committee reveal that Hunter Biden, who called CEFC vice-chairman Patrick Ho the “f–king spy chief of China,” was retained by Ho for $1 million to provide “Counsel to matters related to US law and advice pertaining to the hiring and legal analysis of any US Law Firm or Lawyer.”

Hunter noted that deals with CEFC would be “interesting for me and my family,” with Hunter and his uncle James Biden earning $4.8 million from CEFC China Energy in 2017 and 2018. Amid the leaks, James Biden sought information about Ho’s status, emailing a retired Secret Service agent turned private investigator in November 2017 with the subject line, “Re new case I need ASAP—I’m in Hong Kong.”

The email requested a background check on Ho, citing concerns about a possible arrest warrant. The investigator, unable to find an active warrant, cautioned James Biden that such information could be sensitive and not always accessible.

James Biden later testified to Congress in February 2024, denying any intent to inform Ho, stating, “Absolutely not,” and claiming he sought the information “for my own edification.”

The Inspector General report does not accuse James Biden of wrongdoing and omits mention of Hunter Biden.

The report condemned McGonigal’s actions, stating, “McGonigal’s actions, while he served as a high-ranking FBI official entrusted with overseeing sensitive counterintelligence and criminal matters, were extraordinary and dishonored the FBI’s core values of integrity, accountability, and leadership expected of all FBI personnel.”

His leaks, the report concluded, “intentionally damaged an important criminal case, violated the public trust, and compromised the integrity of the FBI.”
