Sen. Cotton Urges IRS to Investigate CAIR’s Nonprofit Status

On August 5, 2025, Sen. Tom Cotton (R-Ark.) sent a letter to the Internal Revenue Service (IRS) requesting the revocation of the nonprofit status of the Council on American-Islamic Relations (CAIR), citing alleged ties to terror groups, including Hamas and the Muslim Brotherhood.

Cotton referenced CAIR’s designation as an unindicted co-conspirator in the 2007 Holy Land Foundation (HLF) terrorism financing case, described by the Justice Department as the largest of its kind in U.S. history.

The DOJ found that HLF and its leaders provided approximately $12.4 million to Hamas, resulting in convictions on multiple counts of conspiracy, material support to a designated terrorist organization, and money laundering.

Cotton argued, “Tax-exempt status is a privilege, not a right, and it should not subsidize organizations with links to terrorism.”

CAIR’s Response and Controversial Statements

CAIR rejected Cotton’s claims as “based on debunked conspiracy theories,” comparing his request to McCarthy-era tactics.

In a statement to Fox News Digital, CAIR described itself as “an independent American civil rights organization” with over 30 years of defending constitutional rights and opposing bigotry, terrorism, and genocide.

The group said it condemned the October 7, 2023, Hamas attacks on civilians and the ongoing conflict in Gaza, emphasizing “moral consistency.”

However, CAIR faced criticism after its National Executive Director Nihad Awad, in November 2023, expressed being “happy to see” Palestinians “breaking the siege” during the October 7 attacks, comments the Biden administration condemned as “shocking, antisemitic” through spokesperson Andrew Bates.

The Anti-Defamation League also criticized recent CAIR remarks, including Awad’s claim that Israeli Prime Minister Netanyahu influences U.S. policy and a CAIR Los Angeles director’s reference to Congress and the White House as “Israeli-occupied territories.”

Background and Ongoing Debate

The HLF case linked CAIR to the Muslim Brotherhood’s Palestine Committee, though CAIR’s attempt to remove its name from the unindicted co-conspirator list was unsuccessful.

Cotton’s letter highlighted the IRS’s authority to review whether an organization’s actions align with its tax-exempt purpose, arguing that CAIR’s alleged connections warrant scrutiny.

CAIR countered that it has consistently advocated for civil rights and condemned violence, positioning itself as a defender against anti-Muslim discrimination.

The controversy reflects broader tensions over national security, free speech, and the role of nonprofit organizations, with Cotton’s request raising questions about the balance between oversight and allegations of political targeting.
